As an industry-backed self-regulatory forum that scrutinizes national ad campaigns, the National Advertising Division (NAD) of the Council of Better Business Bureaus reviews various aspects of advertising for truthfulness and accuracy in an attempt to foster public confidence in the credibility of advertising.
Chief executive of the Council for Responsible Nutrition (CRN) Steve Mister has shown considerable favor for NAD and their determination to scrutinize national ad campaigns that slander the dietary supplement trade. In fact, five years ago, Mister commissioned for the CRN to began funding an attorney for the sole purpose of prosecuting false claims about dietary supplements and the NAD. Mister argues that the National Advertising Division remains the cheapest and most affective way to fight dubious claims made by companies of the trade. Mister was quoted saying the following:
“If you go to NAD, you can get an issue resolved in 90 days. If you went to the FTC (Federal Trade Commission) or sued a company for false advertising, you wouldn’t even get the pleadings done in 90 days. Some of the cases the FTC has looked at have taken years to resolve.”
Mister believes NAD, in association with the FTC has considerably diminished false or misleading advertising in regards to dietary supplements over the past five years. Through their unique methods, NAD is able to gain the compliance of many companies accused of false advertising. Those who do not, are forced to deal with the FTC or simply dissolve.
Currently NAD is attempting to create a program that will give them more authority than the U.S. Food and Drug Administration (FDA) or the FTC, who are constrained by a lack of resources and prioritize public health cases above others. By concentrating on more relevant everyday issues in advertising, NAD hopes to resurrect the confidence in the dietary supplements industry as a whole.
