Jack3d Lawsuit
The ambiguous nature of DMAA is the subject of a recent class action lawsuit. Johnnie Pacheco has alleged that Jack3d contains DMAA in a “synthetic form that is both illegal and dangerous.” The lawsuit suggests that DMAA is not a derivative of geranium plants, therefore is a synthetic counterpart. District Court in the Central District of California against Texas-based USPLabs after a military probe discovered traces of DMAA in the blood of two deceased military soldiers.
Pacheco claims that the makers of Jack3d have made false and misleading statements about their supplements’ legality, safety and efficacy. Acknowledging the U.S. Food and Drug Administration’s (FDA’s) recent draft guidance on new dietary supplements (NDIs), Pacheco’s lawsuit states that the Agency does not consider synthetic botanical constituents to be dietary ingredients, even if they are chemically indistinguishable from their ‘natural’ counterparts. “Defendant’s DMAA, because it is synthetic, cannot be a constituent of a botanical and cannot qualify as a dietary ingredient and be legally sold in a supplement… nor could it be an extract of a botanical…. because it was not actually extracted from a botanical.”
