The Senators (Ret.) Firm, LLP has announced the filing of a complaint in Orange County (California) Superior Court on behalf of a client who developed liver and kidney failure after using a “dietary supplement.” Daniel Lineberger, developed acute liver failure after ingesting a dietary supplement that was subsequently the subject of an FDA investigation and a recall of the product by a large distributor.
According to the complaint, Lineberger purchased several products from a Max Muscle retail store in Rancho Cucamonga, California, including “Epio Plex.” The complaint further alleges that one or more of the products contained anabolic steroids or similar ingredients. Epio Plex was recalled by another distributor, BodyBuilding.com, in November of 2009 after the FDA determined that Epio Plex and 64 other supplements may contain steroids associated with serious adverse effects, including acute liver failure.
Lineberger’s liver was damaged to the point where he required a liver transplant as well as a kidney transplant resulting from multiple organ failure. The transplant surgeries were performed by surgeons at Johns Hopkins Medical Center in Baltimore, Maryland.
“Very few people know or fully appreciate the fact that dietary supplements are largely unregulated by the FDA,” said Thomas Moore, Managing Partner of The Senators (Ret.) Firm. Moore noted that many supplements are not tested before they are marketed, and FDA does not review them for safety or effectiveness before they are distributed to the public. “Dietary supplements, especially those sold to promote weight loss or body building, may be ticking time bombs,” said Moore. “Until the damage is done, FDA is largely without power to do anything to protect the public.”
